Rental Terms and Conditions — Rental Brothers Equipment Rental
These Rental Terms and Conditions govern all equipment rentals from Rental Brothers (a division of Foundation Brothers). By completing a booking and picking up equipment from the Otterville yard, the renter agrees to be bound by these terms. Please read carefully before booking. Forquestions about these terms, contact the yard before booking. A copy of these terms is included in your booking confirmation email.
Definitions
"Rental Brothers" refers to Rental Brothers, a division of Foundation Brothers, operating from 265927 Maple Dell Rd, Otterville, ON N0J 1R0.
"Renter" refers to the individual or company that completes a booking and takes possession of equipment from the Rental Brothers yard.
"Equipment" refers to any machine, tool, trailer, or attachment rented from the Rental Brothers fleet.
"Rental Period" refers to the booked duration from confirmed pickup time to confirmed return time as specified in the booking confirmation.
"Security Deposit" refers to the refundable amount held against the renter's credit card at pickup, released on satisfactory return of the equipment.
Booking, Payment, and Confirmation
All bookings are made online at equipmentrentalbrothers.com through the Booqable booking system. Payment is processed through Stripe at the time of booking. Bookings are confirmed by email upon successful payment. The renter must present the booking confirmation email at pickup.
Rental rates are displayed during the booking process and include the equipment for the selected rental period. Rates do not include fuel, operator transportation, or any attachment not explicitly included in the booking. Sales tax is applied at the applicable Ontario rate where required.
Rentals are subject to equipment availability. In the unlikely event that equipment becomes unavailable after booking, the renter will be contacted and offered an alternative machine or a full refund.
Security Deposit
A security deposit is required for all heavy equipment and trailer rentals. The deposit amount is displayed during the booking process. The deposit is held against the renter's credit card at pickup and released upon satisfactory return of the equipment.
The security deposit will be applied in whole or in part to cover: repair costs for damage beyond normal wear; fuel costs if equipment is returned below the pickup fuel level; cleaning charges if equipment is returned with significant non-standard dirt, debris, concrete, or material buildup; or late return charges if equipment is returned after the agreed return time without prior notification.
Normal wear — minor surface scuffs, bucket tooth wear consistent with standard operation — is not chargeable against the deposit.
Renter Responsibilities
The renter accepts full responsibility for the equipment from the time of pickup to the time of return. The renter is responsible for:
¥ Operating the equipment safely and in accordance with the manufacturer's operating guidelines and all applicable Ontario legislation including the Occupational Health and Safety Act
¥ Ensuring all operators are competent to operate the equipment — on commercial job sites, ETAC or equivalent training documentation may be required by the site supervisor
¥ Fuelling the equipment correctly — diesel equipment must receive only diesel fuel; gasoline equipment must receive the correct fuel and oil mix as specified at pickup
¥ Securing the equipment when not in use to prevent theft or unauthorised operation
¥ Returning the equipment clean, fuelled to the same level as at pickup, and undamaged beyond normal operating wear
¥ Immediately notifying Rental Brothers of any mechanical failure, accident, theft, or damage to the equipment during the rental period
¥ Ensuring adequate tow vehicle and trailer capacity for any equipment transported on a trailer — never exceeding the manufacturer's rated tow capacity of the tow vehicle
The renter is responsible for all costs associated with damage caused by misuse, operator error, incorrect fuelling, overloading, or operation outside the equipment's rated capacity.
Damage Policy and Liability
Equipment condition is documented with photographs at pickup and return for all heavy equipment rentals. Any damage identified at return beyond the condition documented at pickup will be assessed and the cost of repair deducted from the security deposit. If repair costs exceed the deposit, the renter is responsible for the balance.
The renter is fully liable for any third-party property damage or personal injury caused by the operation of the rented equipment during the rental period. Rental Brothers strongly recommends that renters confirm their personal or business liability insurance covers the operation of rented equipment. Rental Brothers does not provide insurance coverage for rented equipment or third-party liability arising from equipment operation.

Cancellation and Modification
Cancellations made more than 48 hours before the scheduled pickup time are eligible for a full refund minus a cancellation processing fee. Cancellations made within 48 hours of scheduled pickup may forfeit the deposit. Cancellations made on the day of pickup with no advance notice will forfeit the full rental amount.
Rental extensions are available subject to equipment availability. Contact the yard as early as possible if additional rental time is required. Late returns without prior notification are subject to additional daily rental charges and potential deposit deductions.
Pickup Requirements
The renter must present at pickup: a valid government-issued photo identification; the booking confirmation email; and the credit card used for booking for the deposit hold. If renting a trailer or transporting equipment, the tow vehicle must have a compatible ball hitch or fifth-wheel connection, safety chains, and functioning electrical connector. Rental Brothers reserves the right to refuse pickup if the tow vehicle is clearly inadequate for the load.
